Booking Terms and Conditions
When you make a booking you enter into a contract with Julian Sykes trading as Oliva Rama Tours (Julian Sykes Wildlife Holidays) of Avinguda Font d'en Carros 16, Oliva 46780, Valencia, Spain. These booking conditions, together with the information set out in the relevant tour details on the Oliva Rama Tours website form the basis of your contract. In these Booking Conditions, “you” and “your” mean all persons named on the booking (including anyone who is added or substituted at a later date). “We”, “us” and “our” mean Oliva Rama Tours (Julian Sykes Wildlife Holidays).
- What’s Included
1:1 Holidays price includes: all land travel, accommodation and meals with some drinks as specified in the itinerary of each individual holiday and the services of the tour leader(s) throughout. The following items are not included in the cost: return flights to the agreed destination, travel insurance, passport and visa costs, vaccinations and medication, excess baggage charges, telephone calls, laundry, drinks and food (unless specified in the tour details), tips and items of a purely personal nature. In the event that the tour does not include return flight, we will on request give you plenty of notice of the release dates of the airline so that you can arrange your own flights.
1:2 Changes in the itinerary may occur even though tours are carefully planned. Indeed, changes will be made to the stated itinerary if in our sole opinion it will benefit the tour by providing better bird-watching opportunities. The itinerary detailed in the tour pages is therefore an illustration of the sites we may visit to gain the maximum bird-watching benefit from the tour, in our sole opinion. As a courtesy to you, any major changes to the itinerary will be advised either prior to the start of the tour or during it.
1:3 Accommodation will be in medium-standard hotels or hostel, often with private facilities, unless specified in the tour details. Single rooms are normally available at extra cost. If you are travelling singly, but want to share a room, every effort will be made to find someone of the same sex for you to share with; if this is not possible however, we will have to pass on the single supplement charge imposed by the hotel/guest house. If you have reserved a single room on a tour and one is not available, you may expect a pro-rata refund for that day
1:4 General and more specific information will be made available within one month of the departure date to all tour participants. This may include details such as climate and clothing requirements, recommended reading, bird species we are likely to encounter, flight/ferry information, etc. Please note, however, that there is absolutely no guarantee whatsoever that specific bird species will be seen. Events such as floods, storms, fires etc. may prevent the tour from visiting certain areas resulting in specific bird species being missed, We will not accept responsibility for this, any list provided is merely an indication of the species we may encounter on a tour.
- Reservations & Payments
2:1 To make a booking you must complete a Booking Form and send it to us with a deposit of up to 20% of the cost of the holiday. Once the Booking Form and the deposit have been received a confirmation invoice (or e-mail) will be posted to you. At this point, a contract between the you and us comes into existence, with all contracts and matters arising from it are subject to Spanish law and the exclusive jurisdiction of the Spanish courts. We reserve the absolute right to decline any applications for bookings for any legal reasons whatsoever, at our sole discretion.
2:2 Payment of the balance of the tour cost of the holiday is due at least six weeks prior to the departure date. If you do not pay the said amount at that time we reserve the right to treat the booking as cancelled and to retain the deposit.
2:3 You may cancel your booking in writing at any time. As we incur costs from the time we confirm your booking the charges set out below will apply and charge a cancellation fee, plus keep the total cost of the paid deposit
• More than 42 days before departure: loss of deposit
• Between 29 and 42 days before departure 60% of the holiday cost
• Between 15 and 28 days before departure 80% of the holiday cost
• 14 days or less before departure (or failure to join the holiday) 100% of the holiday cost
These dates refer to the date that we receive notice of cancellation from you, and therefore you're strongly recommended to take out travel insurance to cover you in event of a cancellation.
2:4 You may transfer your booking up to 30 days before departure to another person if you are unavoidably prevented from travelling, and the transferee meets any conditions which may apply to the booking. Where a transfer can be made the right to transfer is subject to payment of an administration fee of £50 per person together with all additional charges of whatever sort imposed by the suppliers providing the component parts of the holiday charges. For flight inclusive bookings, you must pay the charges levied by the airline concerned. As most airlines do not permit name changes after tickets have been issued for any reason, these charges are likely to be the full cost of the flight.
2:5 Save as provided in 2:6 or 2:7 below, deposits are non-refundable but in some cases may be transferable to another specified of our holidays or short breaks when you will be responsible for a transfer fee of £50.
2:6 When calculating my the tour prices in advance, we try to anticipate the rising costs of ground transportation, fuel and accommodation. We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any error of which we are aware and of the then applicable price at the time of booking. If unexpected cost rises do occur after your booking has been confirmed, we may have to increase the tour cost. If it is necessary to increase the tour cost, you will be notified not less than six weeks before the departure date with an explanation of the amount. Should it be necessary to increase the tour cost by more than 10%, participants you may withdraw without penalty.
2:7 We reserve the right to cancel any tour for which there are insufficient reservations not less than six weeks before the departure date (see note 3.3). In the event of any such cancellation, all deposits or other payments made specifically to us will be refunded in full.
2:8 Payments of deposits and of the balance due can be paid by cheque, cash or by electronic transfer into either our British or Spanish bank accounts. Further information will be provided at the time of booking.
3:1 Travel insurance is absolutely essential; it is a condition of booking that suitable cover be arranged by you for all destinations outside the UK. This must cover you fully against medical expenses, injury, death, repatriation, cancellation and curtailment, baggage and money loss and liability cover. We will absolutely insist on proof of effective travel insurance cover being produced to us prior to departure, it is your responsibility to obtain it and Julian Sykes Wildlife Holidays reserves the right to refuse travel with no refund without proof of cover.
Please read your policy details carefully and take them with you on holiday. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs. We do not check alternative insurance policies.
3:2 Our tours do not normally entail strenuous activity but, if this cannot be avoided, it will be made clear in the tour details. Nevertheless, you must be able to complete moderate walks of several miles a day sometimes on uneven or slippery surfaces, to meet the schedule of the tour. If you have any health problems or physical limitations you are required to advise us prior to booking. To cater for the needs of all levels of birdwatcher, our tours sometimes involve early starts or late finishes and the travelling of long distances. Subject to the itinerary of the tour however, we can usually arrange for a half or a full day's rest for those who wish to opt out at any time.
3:3 The maximum group size is usually six, excluding one leader. A suitable maximum group size to enjoy the tour will depend upon the location. As a guide, however, any group size over six will have a second leader. We reserve the right to change leaders without notice. The minimum size of a group is usually four participants, and if the number of bookings does not reach this figure within six weeks of the commencement of the proposed tour we reserve the right to cancel the tour and refund the full amount paid by you
3:4 The success of each holiday depends to a great extent on the members of the party’s ability to participate physically and cooperate with other party members and the leader. The leader has full authority to exclude any member, either from part of the daily programme or, in extreme cases, from the entire tour if he or she is, in the reasonable opinion of the tour leader, either physically unable to participate, behaves in a way which is detrimental to the interests or safety of the party as a whole, is inadequately equipped or does not have travel insurance, without any liability on our part. Refunds may be made in appropriate cases at our discretion.
3:5 We will take all reasonable steps to ensure that all services provided are of an acceptable standard. We cannot however, accept liability for physical injury, loss, damage or expense resulting from any event whatsoever beyond my our control. Insurance is therefore absolutely essential.
3:6 Whilst the greatest care is taken in the preparation of my our tour details, mistakes can occur. Unless the error or omission has a major effect on the tour to the extent that the number of species seen is materially affected then no claim for compensation can be entertained.
